Federal High Court Threatens to Dismiss Case Against Sowore Over Procedural Issues

Justice Emeka Nwite of the Federal High Court in Abuja has threatened to dismiss the case against presidential candidate Omoyele Sowore if the prosecution fails to address procedural issues.

The court was set to re-arraign Sowore, the presidential candidate of the African Action Congress (AAC), but only he appeared in court.

The prosecution counsel, Mariam Okorie, informed the court that the hearing notice had not been served on the second defendant, Olawale Bakare.

Sowore’s counsel, Mr Marshall Abubakar, accused the prosecution of attempting to frustrate his client by not serving the second defendant the hearing notice.

Abubakar added that he had written to the Attorney-General of the Federation and Minister of Justice requesting that the charges be severed so that Sowore could stand trial alone.

Justice Nwite ruled that an adjournment would be granted with the condition that the prosecution complies with the court’s order to serve the second defendant by the next adjourned date.

He warned that failure to comply would result in the case being struck out. The matter is adjourned until December 5.
