NNPP Appeals to Supreme Court in Battle Over Kano State Governor’s Sacking

The New Nigeria People’s Party (NNPP) has taken its case to the Supreme Court, seeking to overturn the ruling of the Court of Appeal that upheld the tribunal’s decision to remove Kano State Governor Kabir Yusuf from office.

The NNPP, in its appeal, has presented ten grounds of error made by the Court of Appeal, urging the Supreme Court to review and annul the decision.

In the appeal documents obtained by SaharaReporters, the NNPP listed key issues where it believes the Court of Appeal erred.

The case involves the NNPP as the appellant, Governor Yusuf Kabir as the first respondent, the All Progressives Congress (APC) as the second respondent, and the Independent National Electoral Commission (INEC) as the third respondent.

NNPP is dissatisfied with the Court of Appeal’s judgment delivered on November 17, 2023, and has raised critical concerns about the legal reasoning applied.

The party contends that the Court of Appeal misdirected itself in law, leading to a miscarriage of justice against the appellant.

Among the grounds of appeal is the assertion that the Court of Appeal wrongly delved into an issue related to the qualification of the appellant’s candidate, even though the trial tribunal had resolved the matter in favor of the appellant.

NNPP argues that the Court of Appeal overstepped its jurisdiction by addressing an issue that was not raised in the appeal.

NNPP also questions the Court of Appeal’s mixing up of the issue of party membership register for use at party primaries with the qualification to contest the general election.

The party contends that the Court of Appeal misunderstood the core issues and made a decision that contradicts established legal principles.

The relief sought by the NNPP includes an order allowing the appeal, setting aside the judgment of the Court of Appeal, and upholding the portion of the judgment that sets aside the decision of the trial Tribunal.
