Federal High Court Sets Date for Ruling on NPC’s N200 Billion Expenditure for 2023 Census

The Federal High Court in Abuja has scheduled April 16 as the date for delivering judgment in a case where the National Population Commission (NPC) is being sued to account for the usage of N200 billion from its allocated funds for the 2023 census.

The plaintiff, Victor Opatola, a lawyer representing himself, accused the NPC of withholding detailed information on the expenditure of N200 billion earmarked for preparations leading up to the postponed 2023 population and housing census.

During the recent court session presided over by Justice Inyang Ekwo, both parties presented and adopted their processes. Mr. Opatola informed the court that all necessary documents had been filed and exchanged with the defendant, while the NPC’s counsel, C.D. Chimezie, confirmed the same for his client.

In May 2023, the NPC’s executive chairman, Nasir Kwarra, disclosed that the commission had utilized N200 billion out of the N800 billion required for the census preparations. However, Mr. Opatola filed a Freedom of Information (FOI) application in March 2023, seeking details on the commission’s budget for the census, the funds received, and other pertinent information. He lamented that the NPC had failed to respond to his request, despite acknowledging receipt.

The lawyer urged the court to issue several orders of mandamus directing the NPC to provide comprehensive and detailed information on various aspects related to the census, including the technology to be used, funds received, and budget submissions. He argued that the NPC’s refusal to comply with the FOI request constituted a violation of the FOI Act.

Mr. Opatola clarified that his request for information about the census technology aimed to ensure its compliance with global standards. Additionally, he sought transparency in the awarding of contracts and jobs to prevent conflicts of interest that could undermine the census’s integrity.

Justice Ekwo adjourned the case until April 16 for the judgment.
